1. Data Protection

2. Collecting and Processing Your Information
a. Whenever you visit our websites, we store certain information including but not limited to, about the browser and operating system you are using;
the date and time of your visit; the status of the interaction (e.g. whether you were able to access the website or received an error message);

This is for security reasons; in particular, to prevent and detect attacks on our websites or attempts at fraud.

a. We may transfer the personal information shared with us on our website or otherwise with third parties including but not limited to the Authorised Dealers, Group Companies, our Service Providers, to fulfill the Purpose. They may further transfer your personal information to other third parties in pursuance of any contract to fulfill the Purpose.
b. Our websites may also contain third-party offers. If you click on any such offers, we will transfer the necessary data required to the appropriate provider (e.g. the fact that you found the offer in question on our website and, if applicable, additional information that you have already provided for this purpose on our websites).
C. On our websites, whenever there is a use of so-called "social plugins" from social networks like Facebook, Twitter and Google+, we incorporate them in the manner described below.
When you visit our websites, social media plugins are deactivated. That means no information, whatsoever, is transferred to the operators of those networks. If you wish to use one of the networks, click on the appropriate plugin in order to be connected directly to that network's server.

Terms & Conditions of ”Love For The Star” Contest by Mercedes-Benz India
1. An individual being a citizen of India and having attained the age of 18 years or above shall be eligible to participate in the ‘Love For The Star’ Contest (hereinafter referred to as ‘contest’).
2. Mercedes-Benz India Private Limited (hereinafter referred to as Mercedes-Benz India) has initiated this contest and any participation in this Contest shall be voluntary.
3. Employees of Mercedes-Benz India and their blood relatives are not eligible to participate or win any prizes under this Contest. The residents of Tamil Nadu shall not be eligible to participate in the Contest in compliance with the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.
4. The Contest shall start on 12th Feb and end on 14th Feb 2022 (12:00 Hours IST). Mercedes-Benz India may curtail or extend the contest period, at its sole discretion without any prior intimation.
5. The participant shall follow Mercedes-Benz India’s Instagram, Facebook and either comment on the contest announcement post or share an image/video expressing their #LoveForTheStar.
6. A video or image post shall qualify as an eligible entry to the Contest only if the participant tags @mercedesbenzind and uses #LoveForTheStar hashtag in the post.
7. The Contest will be conducted on Instagram and Facebook and the criteria for winner selection will be based on a lucky draw. Ten(10) lucky winners will get some exciting goodies from Mercedes-Benz India.
8. The Winners shall be selected solely by Mercedes-Benz India via a lucky draw to be held at its registered office. Ten (10) lucky winners will be selected by way of a random selection process in a lucky draw. Winners will be announced on social media platforms (Instagram and Facebook) in the 1st week of March 2022 and after the details verification the prizes will be sent to the lucky winners.
9. Upon intimation of being selected as a Winner, the Winner will be required to submit his/her identity proof. Winners hereby acknowledge that their personal data including but not being limited to name, contact details, address, identity proof documents will be obtained as a part of the Contest and in order to verify the Winners and that they do not have an objection to the said collection and processing of personal data. Winners hereby grant Mercedes-Benz India the right to use their personal data as mentioned above, as would be required for the purpose of this Contest. Mercedes-Benz India shall take all decisions in respect to this Contest, including but not limited to the procedure of selection of winners, type of prizes, time for announcement etc. and the same will be final and binding on a non-contestable basis.
10. If the prize is unclaimed /undeliverable Mercedes-Benz India reserves the right to offer the unclaimed prize to a substitute winner.
11. Prizes/Goodies are non-transferable and cannot be exchanged for cash. Mercedes-Benz India shall not be liable and it accepts no responsibility for any winner’s prize in case of non-confirmation.
12. Mercedes-Benz India shall not be liable for any direct or indirect loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered by the Participant, because of participating in the contest.
13. Mercedes-Benz India reserves the right to withdraw the Contest and/or alter, delete or modify any/all of the terms & conditions of this contest any time without prior notice.
14. Any dispute arising out of or in connection with this Contest shall be subject to the exclusive jurisdiction of the Courts at Pune, Maharashtra only. The existence of dispute, if any, shall not constitute a claim against Mercedes-Benz India.
15. By participating in this Contest, the participants accept and agree with the Terms and Conditions of participation as specified above in totality.
Terms & Conditions of ‘Star Quiz’ Contest by Mercedes-Benz India
1. An individual being a citizen of India and having attained the age of 18 years or above shall be eligible to participate in the ‘Star Quiz’ Contest (hereinafter referred to as ‘contest’).
Mercedes-Benz India Private Limited (hereinafter referred to as Mercedes-Benz India) initiates this contest and any participation in this Contest shall be voluntary.
2. Employees of Mercedes-Benz India and their blood relatives are not eligible to participate or win any prizes under this Contest. The residents of Tamil Nadu shall not be eligible to participate in the Contest in compliance with the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.
3. The Contest starts on 26th Dec and ends on 30th Dec 2021 (00:00 Hours IST). Mercedes-Benz India can curtail or extend the contest period, at its sole discretion without any prior intimation.
4. The participant has to follow Mercedes-Benz India’s Instagram, Facebook and answer the questions correctly on Instagram or Facebook posts.
5. The contest will be conducted on Instagram and Facebook and the criteria for winner selection will be based on a lucky draw. 50 lucky winners will get some exciting goodies from Mercedes-Benz India. The winners will be selected from India only.
6. The Winners shall be selected solely by Mercedes-Benz India via a lucky draw contest to be held at its registered office. 50 lucky winners will be selected by way of a random selection process in a lucky draw. Winners will be announced on social media platforms (Instagram and Facebook) in 1st week of January 2022 and after the details verification the prizes will be sent to the lucky winners.

Important Information on Payment Services
1. This payment will be processed by the Payment Service Provider i.e PayU Payments Private Limited trading as PayU in association with Mercedes pay GmbH (Mercedes pay), on behalf of Mercedes-Benz India Private Limited(MB India).
2. The payment methods provided by PayU and Mercedes pay are secure and comply with global industry standards for payment processing including PCI DSS.
3. Your financial details shall not be stored by Mercedes pay, Authorised Agent or MB India (collectively referred to as ‘Parties’).
4. MB India and/or Mercedes pay shall not be held liable for any additional charges imposed on the transaction by the Bank or Financial Institution whose banking/financial services including but not limited to UPI, Credit Card, Debit Card, Netbanking, are being used by the customer.
5. In case of any discrepancy in the payment amount, the customer and the Authorised Agent shall mutually agree to the amount of refund, if any. The refund amount so agreed shall be refunded via the same mode as that of the payment within 15 (fifteen) days from the date of such mutual decision.
6. The parties may collect personal and sensitive personal Information about the customer including but not being limited to the name, address, contact details, payment transaction details etc. for the purpose of facilitating and/or completing the payment and its associated transactions if any. The customer agrees to the collection of such personal and sensitive personal information by the parties as will be required to execute and complete the payments and its associated transactions.
7. Further, the customer is aware and acknowledges that the personal information/data including vehicle data submitted by the customer may be transferred to and/or processed by MB India, its Authorised Franchise Partner and / or Authorized Dealer, Mercedes-Benz Group AG and/or any Mercedes-Benz Group Company wherever located for effecting the payment or any other activity required to be carried out for providing efficient services in relation to the workshop/job order.

Terms and Conditions of Win an experience with M.S Dhoni (“Contest”) by Mercedes-Benz India:
1. An individual being a citizen of India and having purchased a Mercedes-Benz Car (“Vehicle”) between 1st September 2023 and 30th November 2023 (both days inclusive) shall be eligible to participate in the Contest. This contest is limited to the purchase of A-Class, C-Class and E-Class. This Contest is initiated by Mercedes-Benz India Private Limited (“Mercedes-Benz”) and any participation in this Contest shall be voluntary.
2. Employees of Mercedes-Benz and their blood relatives are not eligible to participate or win any prizes under this Contest. The residents of Tamil Nadu shall not be eligible to participate in the Contest in compliance with the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.
3. The Contest starts on 10:00AM 1st September 2023 and ends on 23:00PM 30th November 2023 (Hours IST). Mercedes-Benz India reserves the right to curtail or extend the contest period, at its sole discretion as may be deemed fit in the interest of the contest.
4. Participants hereby acknowledge that their personal data including but not being limited to name, contact details, address, identity proof documents etc. will be obtained as a part of the Contest and that they do not have an objection to the said capturing of personal data. Participants hereby grant Mercedes-Benz the right to use their personal data as mentioned above, as would be required for the purpose of this Contest.
5. Mercedes-Benz shall take all decisions in respect to this Contest, including but not limited to type of prizes, venue, date & time for announcement of results, publication of results etc. and the same will be final and binding on a non-contestable basis.
6. Entries will be judged on the basis of random selector by Mercedes-Benz. The decision of Mercedes-Benz shall be final and binding.
7. The winners of the Contest will need to make themselves available for the meet and greet with MS Dhoni at venue and date duly decided by Mercedes-Benz (“Venue”) in due course. The cost of travel, lodging and boarding at the Venue for the winners shall be borne by Franchise Partner.
8. Mercedes-Benz shall not be responsible for obtaining the travel insurance of the winner. Travel insurance related formalities shall be completed by and charges shall be borne by the winners for themselves.
9. Mercedes-Benz will announce and communicate to the winners via email. The winners shall reply to the email and acknowledge the acceptance of the prize within 15 days of receiving the email. If the prize is unclaimed after this time, it will lapse, and Mercedes-Benz reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules.
10. In case of any unforeseen travel restrictions or event cancellation the winners would be eligible for a complimentary reward in cash or kind. The complimentary reward shall be offered on non-negotiable basis. Decision taken by Mercedes-Benz shall be final and binding in this regard.
11. The participant shall not claim any intellectual Property right violation over the content, views and / or ideas shared or posted in regard to the Contest on the social media.
12. Winner are aware that their images/videos may be captured as a part of the Contest and they do not have an objection to the said capturing of images/videos. They hereby grant Mercedes-Benz the right to use and / or share the images and videos with their event partners for any promotional purpose related to the Contest.
13. Mercedes-Benz shall not be liable for any direct or indirect loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered, as a result of participating in the contest.
14. Any dispute arising out of or in connection with this Contest shall be subject to the exclusive jurisdiction of the Courts at Pune only.
15. By entering the Contest, the participants agree not to make any claims (including special, indirect and consequential losses) against Mercedes-Benz India or its directors and employees and any losses, claims and actions of any kind resulting from the Contest and acceptance of any prize, shall be at the sole liability of the Winner.
16. Mercedes-Benz may be due to any Force Majeure event suspend, postpone or cancel the contest particularly the face of challenge and the contestants will not be entitled to claim any compensation, costs for such postponement, suspension or cancellation.
17. By participating in this Contest, the participants accept and agree with the Terms and Conditions of participation as specified above.
Terms and Conditions of Sustainability Drive Tournament (“Contest”) by Mercedes-Benz India Private Limited (“Mercedes-Benz”):
1. This Contest is initiated by Mercedes-Benz and any participation in this Contest shall be voluntary. By participating in this Contest, the participants accept and agree with the Terms and Conditions of participation as specified below
2. Eligibility to the Contest:
a) Must be a citizen of India.
b) Must have participated in the Mercedes-Benz Golf Tournament schedule from 3rd November to 31st December 2023.
c) Must have mandatorily booked a test drive for EQS 580 between 1st November 2023 and 31st December 2023 (both days inclusive).
3. Non-Eligibility to the Contest:
a) Employees of Mercedes-Benz and their blood relatives are not eligible to participate or win any prizes under this Contest.
b) The residents of Tamil Nadu shall not be eligible to participate in the Contest in compliance with the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.
4. Tenure of Contest:
a) The Contest starts on 10:00AM 1st November 2023 and ends on 23:00PM 31st December 2023 (Hours IST). Mercedes-Benz reserves the right to curtail or extend the contest period, at its sole discretion as may be deemed fit in the interest of the contest. MB India reserves the rights to revoke this contest anytime without any prior intimation.
5. Winner selection by Mercedes-Benz:
a) Mercedes-Benz shall take all decisions in respect to this Contest, including but not limited to type of prizes, venue, date & time for announcement of results, publication of results etc. and the same will be final and binding on a non-contestable basis.
b) Entries will be judged on the basis of random selector by Mercedes-Benz. The decision of Mercedes-Benz shall be final and binding.
c) Mercedes-Benz will announce and communicate to the winners via email. The winners shall reply to the email and acknowledge the acceptance of the prize within 15 days of receiving the email. 6. Contest Prize:
a) The winner of the Contest will get an EQS 580 (“Vehicle”) along with wall box charger required for the Vehicle for a period of one year. The one-year period commences from the date of handing over the vehicle to the winner.
b) The winner shall be solely responsible for making all required arrangements for charger Installation including enhancement of electricity load etc from the Electricity Distribution Company. The cost of installation of charger shall be borne by the MBIL. Any changes/ modifications or permissions required shall be borne by the winner.
c) Acceptance of prize shall be at the sole liability of the winner.
d) The Vehicle will be made available by the Mercedes-Benz in the resident state of the winner.
e) The Vehicle will be comprehensively insured and registered at the winner's location.
f) A MoU regarding usage of the Vehicle will be executed between Mercedes-Benz and the Winner.
g) The winner needs to make themselves available for collection of the Vehicle at venue and date duly decided by Mercedes-Benz (“Venue”) in due course. The cost of travel to the Venue for the winners shall be borne by winner.
h) Taxes deductible on above winning/prize, if any, will be borne by MB India.
7. Obligations of the winner:
a) The Vehicle will be owned by MB India and as such the winner shall use it prudently and with care.
b) The winner shall at all times not give the Vehicle to any third person for driving except its immediate family members i.e. spouse, daughter, son, who holds a valid driving license.
c) The winner shall ensure that winner or its immediate family members driving the Vehicle shall possess a valid driving license (while driving the vehicle) shall comply with the provisions of the Motor Vehicles Act, 1988 and any statutory amendments, modifications, re-enactments thereof and any other applicable law/s.
d) The Vehicle shall be parked in a protected / enclosed area to guard against vandalism or theft.
e) The Vehicle shall not be used for stunt driving / racing or in any way involving an element of risk or for any other illegal purpose.
f) The Vehicle shall not be driven under the influence of any kind of alcohol, intoxication, consumption of drugs etc.
g) The winner undertakes to comply with all the rules, regulations, statues, notifications, speed limits of various roads, highways, during possession and use of the Vehicle.
h) Electricity Consumption Charges during the period of one year shall be borne by the winner.
i) In case of any accident or damage while the Vehicle is in the possession of the winner, Mercedes-Benz shall be immediately intimated about the same. The Winner shall be liable to pay Mercedes-Benz for cost of any damage not covered by the insurance policy.
j) The Winner shall be solely liable and responsible for payment of fines, penalties and levied for violation of Traffic Laws.
k) The Winner shall take the Vehicle to the nearest authorized dealer workshop for any service measure / recall if announced on the Vehicle by Mercedes-Benz.
l) Mercedes-Benz is not obliged to provide an alternate vehicle during the time the Vehicle is in the workshop for any reason.
m) The Winner shall return the Vehicle immediately upon completion of 1 year from the date of handover .
n) Winner shall provide his PAN to MB India for Tax reporting, if any.
8. Rights of Mercedes-Benz:
a) MBIPL reserves absolute right to call the Vehicle back at any time without any prior notice if the Vehicle is misused or poorly handled or if in the opinion of Mercedes-Benz, the rules and regulations under the Motor Vehicles Act have not been complied with
b) Mercedes-Benz may inspect the Vehicle from time to time after giving the Winner a reasonable advance notice.
9. Intellectual Property:
a) The winner shall not claim any intellectual Property right violation over the content, views and / or ideas shared or posted in regard to the Contest on the social media.
b) Any publicity or use of photographs or MBIPL’s registered trademark is strictly prohibited, unless, previously approved in writing by Mercedes-Benz.
10. Consent to Data:
a) Participants hereby acknowledge that their personal data including but not being limited to name, contact details, address, identity proof documents etc. will be obtained as a part of the Contest and that they do not have an objection to the said capturing of personal data. Participants hereby grant Mercedes-Benz the right to use their personal data as mentioned above, as would be required for the purpose of this Contest.
b) Winner is aware that their images/videos may be captured as a part of the Contest, and they do not have an objection to the said capturing of images/videos. They hereby grant Mercedes-Benz the right to use and / or share the images and videos with their event partners for any promotional purpose related to the Contest.
11. Indemnity:
a) In consideration of the winner being permitted to use the Vehicle, the said the winner shall indemnify and keep Mercedes-Benz indemnified and harmless for and against all liabilities, whatsoever, including criminal liability arising out of any accident or damage, which may occur to Mercedes-Benz or to any other third party towards any payment which may become payable under / pursuant to the said accident or otherwise and against all actions, proceedings, claims, damages, cost and expenses, whatsoever, in relation thereto or arising out of the use of the Vehicle by the winner.
b) Moreover, the winner shall indemnify and keep indemnified Mercedes-Benz, its officers, directors, employees, authorised Franchise Partners and dealer(s), Event Management Company or any of its agency against any lien, suit, cause of action, claim, demand or liability that would otherwise incur, arising from such loss, damage or injury pursuant to the party’s participation during the test drive.
c) Further, Mercedes-Benz, its officers, directors, employees, its Authorised Franchise Partners and Dealer(s), Event Management Company or any of its agency shall not be liable for any loss, damage, injury or illness whether direct, indirect or consequential of whatsoever nature and howsoever caused, suffered by the winner (to his person or property) or to the person accompanying him/her, as a result directly or indirectly, of attending the event and/or participating in the activities, including but not limited to health problems, medical expenses, accidental death or disability, high jacking, baggage loss, loss of cash or other belongings or travel documents, whilst on journey or otherwise, during the use of the Vehicle.
12. Jurisdiction:
a) Any dispute arising out of or in connection with this Contest shall be subject to the exclusive jurisdiction of the Courts at Pune only.
13. Force Majeure:
b) Mercedes-Benz may be due to any Force Majeure event suspend, postpone or cancel the contest particularly the face of challenge and the contestants will not be entitled to claim any compensation, costs for such postponement, suspension or cancellation.
